Enforcement of Judgments 3/27/13

Do you have a judgment in a California Superior Court or Small Claims Court case? Collecting on a judgment is often harder than obtaining the judgment in the first place. This class, intended for Sacramento County Residents seeking to collect without using an attorney or collection agency, will introduce the most common and successful tools used to enforce judgments.
Participants will leave this two hour class with a basic working knowledge of methods of collection, including examining a debtor in court to determine the existence and value of the debtor’s assets; obtaining an earnings withholding order or bank levy; and placing liens against real property. Participants will receive samples of and be able to prepare an Application and Order for Appearance and Examination, used to examine the judgment debtor in court to identify assets; an Earnings Withholding Order, used to garnish the judgment debtor’s wages; a Notice of Levy, used to obtain funds from the judgment debtor’s bank account; and an Abstract of Judgment, used to place a lien against the judgment debtor’s real property.
In addition, several tangential topics will be touched upon, so that, upon completing the class, participants will be able to calculate interest on judgments, renew their judgments when appropriate, and hopefully, file an Acknowledgment of Satisfaction of Judgment.
Finally, participants will receive a list of materials and other resources available at the Law Library, useful for locating judgment debtors and for a more in-depth understanding of collection techniques.
